Terms for customers:-

The terms outlined apply to customers of the My Celebration Day website and our associated mobile applications. If you are a designer/creator and wish to sell your designs/content via the My Celebration Day website, please see our ‘Terms for Creators’. By accessing and/or placing an order on the My Celebration Day website, you agree to be bound by these customer terms . If you do not consent or agree to be bound by these Customer Terms, you should not use, access, or place orders via our My Celebration Day websites.

YOUR ‘MY CELEBRATION DAY’ ACCOUNT

You must use a valid email address to place an order on My Celebration Day. Your details must be complete, true and correct. Failure to meet this expectation may result in an immediate cancellation of an orders without refund (in the event of purchase(s).

If you create, or you are issued with, a user I.D. code, password or any other piece of information as part of our security procedures, such information must be treated confidentially, and must not be disclosed to any third party.

My Celebration Day reserves the right to terminate or suspend your account, user I.D code or password, whether allocated by us or created by you, at any time, if in our reasonable opinion you have:
(1) Breached any of the provisions of these Customer Terms
(2) Breached any other applicable regulations, guidelines or laws
(3) If we deem your conduct as harmful to other users of My Celebration Day, our services or any third parties
(4) If you have not utilised or a accessed your account for a prolonged time period.

If you suspect that your user I.D code or password is known to anybody other than yourself, please notify us immediately at info@mycelebrationdaycom.

You reserve the right to close your account at any time for any reason; to do so, please contact us at info@mycelebrationday.com.
You will no longer be able to access into your My Celebration Day account following the closure of your account at your request.
We reserve the right to retain any data or information associated with your account in accordance with our privacy notice.

ORDER PROCESS

Your orders will be placed via our My Celebration Day upon confirming your order at the end of the checkout process, upon which you will be given an order number. Further instructions on the My Celebration Day website will navigate you through the ordering process.

Order timings

We aim for orders to reach customers between 2-4 business working days from the date the order was placed.

Declined orders

We reserve the right to decline or cancel your order at any time prior to delivery for any reason; Unavailable products, unable to take payment, pricing or description errors.
If your order is declined after a payment has been taken, you will be issued a refund via the initial payment method used when the order was placed.

PRICES & PAYMENT

Postage & packaging are not included in the prices of our cards, and are inclusive of VAT. VAT invoices can be issued upon request for card orders of 5 as a minimum; this can be requested by emailing us at info@mycelebrationday.com. Requested invoices are issued within 7 working days.

The payment methods we accept Visa and MasterCard credit, and debit cards. As we aim to provide the most effective security, all payments are processed securely by our payment processor Stripe.

Following your account creation, the option of having your card details stored securely by Stripe will be offered to you, enabling you to check out on future visits without having re-enter your card details. For extra security and peace of mind, card details are processed by Stripe but are not shared with us. Card details cannot be saved to multiple accounts.

As routine practice, Stripe may send the issuing bank a request for a minimal payment of approximately £1, for authorisation to verify that the card is issued, and the bank will give permission for it to be authorised.

This is a standard security measure from Stripe, which is to ensure that your card is chargeable, and will not effect the overall price you pay for any purchases from the My Celebration Day sites.
Irrespective of whether or not the authorisation is declined, the authorisation request will be reversed immediately.
Please note, if the bank declines the authorisation, the authorisation for the minimal amount on the credit card statement may still be visible. This is not a charge. This will be automatically removed from your statement by your bank within a few weeks.

Promo Codes

On occasion and in line with seasonal marketing guidelines, we may issue Promotional codes, which will have expiry dates. Please note, no credit or cash alternative will be issued as a supplement if a promotional code is not used before its expiry date.

In the event of a refund, the amount will be limited to the promotional price paid and not the full value of the product. The promotional discount code will only apply to the original purchase item and will not be is valid for any subsequent purchases or exchanges..

We reserve the right and discretion to modify the terms of use for promotional codes without prior notice.

Please note we reserve the right to cancel or suspend any of our promotional campaigns at any time.

ORDER CHANGES AND CANCELLATIONS

Order changes

We strongly advise to carefully check your order before finalising and confirming, as may not be able to change or cancel once the order has been placed (other than in exceptional circumstances).

If you believe you have made a mistake with your and wish to make a change, please contact us ASAP us at info@mycelebrationday.com. We will endeavour to make changes wherever we can.
You will be required to do this from the email address your account is registered under and provide us with the order confirmation number.

In order to exercise your right to cancel, you will be required to inform us of your decision to cancel your contract by a clear statement, including; Name, address, order details, phone number, and email address.

If you decide to cancel your order, you or the recipient should return the products to us within 14 days. You must initially cover the postage cost, and we will reimburse you via your initial payment upon receipt of the product. We will only cover the cost to the amount in line with the original postage amount.

We reserve the right to make a deduction from the reimbursement for loss in value or damage of any products returned.

DELIVERY

Cards are delivered via Royal Mail First Class signed post or tracked and signed post for Europe and the rest of the world. We will always endeavour to deliver your order within 2-3 working days, however Royal Mail First Class post does not guarantee one-day delivery service, therefore an exact delivery date cannot be guaranteed. My Celebration Day cannot be held responsible for the late arrival of an item due to any delays by Royal Mail postal or any other circumstances outside our control.

My Celebration Day is unable to provide replacements or refunds for products sent to the wrong location due to an incorrect address entry on checkout.

REFUNDS AND RETURNS

Other than as outlined above in regard to cancelled orders, we can only accept returns/issue replacement products/refunds in the following circumstances.

Damage

My Celebration Day practices strict and stringent quality control measures when printing, packing and dispatching orders, however damage/printing errors can occur on occasion. In such event, please contact us as soon as possible (must be within 30 days).
We will require your order number, in order to arrange a free replacement or a refund if you are able to provide a valid reason for a complete cancellation.

We reserve the right to request photos of the damaged / faulty products in order to be able to issue your replacement or refund. We may also ask for you to return the damaged / faulty products back to us.

Design Errors

We will not be liable for spelling mistakes within the cards. We will always endeavour to assist, and may, offer to replace the design with a corrected version. This will be dependent on the level of co-operation from the purchaser, and also upon the speed at which we receive a picture of the card showing the alleged error. We cannot provide a specific time frame for the completion of this process, but we will aim to be as speedy as possible.

Incorrect products

We follow a meticulous manufacturing process, but very rarely a mistake may be made due to human/machine error. If you receive the wrong product, please contact us ASAP with your order number in order for us to arrange a free replacement or a refund.

Refunds

Generally speaking, we offer free replacements in the event of damaged, faulty or incorrect products. If we are unable to replace an item, or you have a genuine reason for declining a replacement, we may offer a full refund. Refunds will typically equal the total amount paid for the product(s) plus any delivery charges.
7 days is the approximate length of time for this process to be completed.

GENERAL TERMS

Our terms may be changed or updated by us at any time without notice, therefore we strongly recommend that you check these Customer Terms prior to purchasing as they are binding.
This also applies to our sites; content and material, of which we are not obligated to keep current, or maintain its relevance although we, of course, endeavour to.

We also cannot guarantee our sites, or content/material will always be available or be uninterrupted/be free from omissions, nor will we be liable to any users if our site becomes unavailable for any period of time.

We also reserve the right to limit or restrict the availability of our sites, including services or products described on the My Celebration Day websites to any person, or geographic area at any time.

No reliance on information

The content on our My Celebration Day sites are provided as a source of general information only. Our information is not intended to equate to advice on which you should rely.

Intellectual property rights

My Celebration Day Ltd are the owner or the licensee of all intellectual property rights within our online sites, including our content/material. Such works are protected globally by copyright laws and treaties; of which such rights are reserved.

Users are only permitted to use the My Celebration Day sites for lawful purposes and activity only, and cannot be used it in a manner which infringes the rights, restricts, inhibits or hinders the experience of any other site users.

Users must not use our site to carry out the following activities:-

Download
Frame
Print
Disreproduce
Distribute
Re-post/Post
Broadcast
Record
Transmit
Edit
Communicate to the public
Link to, deep-link into, or distribute in any way the web pages or materials on the My Celebration Day sites other than solely for your own personal use.

Failure to comply with the above may result in the immediate suspension of the use of our sites, temporarily or permanent. You will also be asked and expected to return or destroy any copies of the materials you have unlawfully created.

You must not use the My Celebration Day sites or any part of our content or materials for commercial purposes without obtaining licenced permission to do so from us or our licensors.

IP Infringement Policy

My Celebration Day respect intellectual property rights, therefore we expect the same of our customers and creators. Our contributors and creators are responsible for the content which they upload and supply to the My Celebration Day websites, and also for ensuring that they possess the required rights to use, display, and sell that content. If you have reason to believe this is not the case, please contact us via email ASAP with as much information on the matter as possible (info@mycelebrationday.com)

User Conduct

You must not use the My Celebration Day sites to upload, distribute or share any prohibited content including but not limited to the following:-

Copyrighted material used without the granted permission of the original owner
Material that infringes or violates the rights of others
Material that contains viruses, worms, trojan horses or any other forms or variations of corruptive code, or any other content that may compromise or harm the users of the My Celebration Day sites
Material that encourages, entices, or advocates illegal activity.
Material that we believe is obscene, defamatory, slanderous, offensive, abusive, deceptive, pornographic, or otherwise inappropriate.
Material or content that may be deemed harmful to minors; or material that is associated to any of the above.
My Celebration Day reserves the right to determine whether content is prohibited or not, and have the full rights to assess material submitted to our sites at any time. We are not always able to monitor and cannot always control all content posted to the My Celebration Day sites, and we are not liable for inappropriate content.

Our liability

Our liability in relation to faulty or defective products purchased via My Celebration Day, and in relation to any non-delivery, is limited to the issuing of a refund or replacement as outlined above.

While we endeavour to take reasonable care with the content displayed on our sites, we do not offer any warranties, conditions, or guarantees as to the nature of its accuracy.
To the extent permitted by law, we exclude all conditions, warranties and the other terms which may otherwise be implied by statute, common law, or the law of equity.

With the exception of lawful obligation, we do not accept liability for the following:-

Loss of income or revenue
Loss of business
Loss of profits or contracts
Loss of anticipated savings
Loss of data, waste of management or office time
Any indirect or consequential loss or damage of any kind
Personal injury or risk to health or life

The above and not limited to, arising and whether caused by accident or negligence, violation of contract or otherwise, even if foreseeable or for any and all and damages, can be attributed to the use of the My Celebration Day sites.

Viruses, hacking and other offences

No person should introduce viruses, trojans, worms, logic bombs or any other harmful material which may be malicious or cause technological harm. No person must attempt to gain unauthorised access to any of our websites or servers on which the My Celebration Day sites is stored, nor on any computer or database associated with our sites. No person must attack our sites by means of denial-of-service attack or a distributed denial-of service attack. In any occurrence or breach of these obligations, we reserve the right immediately terminate your access to our websites.

Celebration Day Ltd is not liable for any loss or damage caused by a distributed denial-of-service attack, viruses or any other form of technological harm, or harmful materials that may cause infection to your computer equipment, or programs, data, or any other various forms of proprietary material which may arise from the usage of any of our websites, including the downloading of any material/content posted or uploaded onto it, or on any other websites, blogs, or web pages linked to it.

Linking to My Celebration Day sites

Users may create links to our web pages but must be done so in a manner which is fair, legal, honest, and causes no damage our reputation, nor takes advantage of our services, nor claims or suggests any endorsement or untrue/unlawful affiliation.

No person should establish a link from any website, to ours, of which they are not the owner of.
Our websites must not be framed or linked to any other website or web space site.
Celebration Day Ltd reserves the right to withdraw linking permissions without notice.

Links from the My Celebration Day sites

Our sites main contain links to other sites and materials/resources provided by third parties, and third-party sites, and such links are provided for information purposes only. My Celebration Day has no control over the contents of such sites or materials/resources, and we do not accept responsibility for them or any loss or damage that may arise from the use of them by users.

Jurisdiction and applicable law

As a consumer, our terms of use, the subject matter and this formation, are governed by English law. It is in mutual agreement that the courts of England and Wales will have exclusive jurisdiction with the exception of Northern Ireland residents, and persons may also bring proceedings in Northern Ireland. The same applies to Scottish citizens.

These terms also apply to businesses.

These Terms for creators apply to the contribution, uploading, and selling of content/materials and other various uses of the My Celebration Day websites, and other various mobile applications by our creators/contributors. For customers intending to purchase products from the My Celebration Day sites, please see our Terms for Customers (as outlined above). By accessing and/or placing an order on the My Celebration Day website, you agree to be bound by these customer terms . If you do not consent or agree to be bound by these Customer Terms, you should not use, access, or place orders via our My Celebration Day websites.

CREATOR/CONTRIBUTOR ACCOUNT

My Celebration Day provides services (as referred to in these terms as our Services) which are intended to enable creatives/contributors to sell their products, and to enable buyers/customers to purchase such products.

You must use a valid email address to create a creator/contributor account on My Celebration Day. Your details must be complete, true and correct. Failure to meet this expectation may result in an immediate terminate of your creator/contributor account.

Creators/contributors automatically consent to displaying the information you have provided us; photo, bio information, to the public via our My Celebration Day websites.

To retain your creator/contributor account, the expectation is to actively participate in our Services at least once every 365 days.

If you suspect that your user I.D code or password is known to anybody other than yourself, please notify us immediately at info@mycelebrationday.com.

UPLOADING CONTENT TO THE ‘MY CELEBRATION DAY’ SITE

In order to upload material/designs/products to our sites, they must be in compliance with our content standards, and creator conduct obligations as outlined below.

We reserve all rights to make all content available or unavailable which has been uploaded or supplied by creators/contributors . At our sole discretion, the display of your designs may only be limited to your profile and may not appear under our generic category displays. This decision may be mad if we feel your content doesn’t suit the standard of some of our higher quality products or designs.
My Celebration Day reserve full rights right to alter, remove, or relocate any of your material for any reason and at any time, without prior notice or liability to you.

My Celebration Day will not be responsible or liable to you, the creator/contributor, or to any third party for your Content/materials. You as the creator/contributor will be responsible and liable to us, and also to our customers, and to our third-party associates for your Content/materials, and you will own the sole responsibility for the security and backing up/storage of copies of your content/materials.

COPYRIGHT AND OTHER INTELLECTUAL PROPERTY

Your Content:-

The contributor/creator will retain all ownership rights of their Content that is uploaded onto our sites, which also means you grant us full permission to make your Content available for promotion/ sale via our websites for the following:-

Worldwide sales
Non-exclusive sales
Sub-licensing
Transferrable licence to store
Reproduction
Cropping
Framing
Modification
Copying
Distribution
Preparation of derivative works
Display

You also grant us permission to make available to third parties and otherwise use your Content in connection with:-

The promotion/sale of all products sold on My Celebration Day including but not limited to greeting cards.
The marketing of your logo/brand/personal imagery and location to inform customers/audience of the My Celebration Day marketplace brand story.
The operation of the My Celebration Day sites and Services.
The marketing of My Celebration Day business or any part of it in any medium and via any form of media.

My Celebration Day respects the intellectual property rights of other persons, and we expect our customers and creators/contributors to do the same. Creators/contributors are responsible for their own Content and ensuring the acquisition of the necessary rights to use such Content/to grant the licences outlined above. We reserve the right to remove any content if it does not adhere to the conditions outlined above, or if we are legitimately informed of such,

My Celebration Day sites and other content

IP Infringement Policy

We are notified or identify Copyrighted work/products claimed to have been infringed
We are notified or identify material that is claimed to be infringing or to be the subject of infringing
We identify falsehoods with your contact information; address, telephone number, or email address

STANDARDS OF CONTENT AND CREATOR/CONTRIBUTOR CONDUCT

You must not use the My Celebration Day sites to upload, distribute or share any prohibited content including but not limited to the following:-

Copyrighted material used without the granted permission of the original owner
Material that infringes or violates the rights of others
Material that contains viruses, worms, trojan horses or any other forms or variations of corruptive code, or any other content that may compromise or harm the users of the My Celebration Day sites
Material that encourages, entices, or advocates illegal activity.
Material that we believe is obscene, defamatory, slanderous, offensive, abusive, deceptive, pornographic, or otherwise inappropriate.
Material or content that may be deemed harmful to minors; or material that is associated to any of the above.
Material which is otherwise in breach of these Creator Terms.

My Celebration Day reserves the right to determine whether content is prohibited or not, and have the full rights to assess and remove material submitted to our sites at any time. We are not always able to monitor and cannot always control all content posted to the My Celebration Day sites, and we are not liable for inappropriate content.

If you suspect that your Content does not comply with above standards, contacting us at immediately info@mycelebrationday.com, and you must immediately remove the material in question from the My Celebration Day sites.

PAYMENT & COMMISSIONS

Creators/contributors will be credited with a royalty amount of a design belonging to them has been sold (Inc VAT):-

A5 Standard: £0.40
A4 Standard: £0.60

The sums shown above are in English pounds sterling. Countries outside of the UK will receive the equivalent translated amount in accordance with the current exchange rate at the time.

My Celebration Day reserves the right to adjust the royalty rates at any time at our complete discretion.

Royalties are paid to creators/contributors at the end of the month following the month in which they are earned. Creators must have their own PayPal account in order to receive payment, no other payment method can be used.

PayPal payment details must be submitted to us at the time of opening your account with us.
Due to PayPal fees, our minimum monthly royalty payment we can issue is £5. If this amount is not made within a month, your royalties will roll over to the next consecutive month where this sum has been reached or exceeded.

In the occurrence of a customer refund of your product for any reason, we reserve the right to cancel or reclaim the related royalty payment back from you.

Payments unclaimed by creators/contributors before 30 days will be returned to us by PayPal, and we will not be liable for this, or if the reason is due to incorrect PayPal details being submitted initially by the creator/contributor. Unclaimed funds will remain on a creators/contributors account for 365 days, after this, it will be cancelled permanently.

If a creator/contributor purchases their own card, we will deem this as an order sample, of which, no royalty is awarded.
Contributors/Creators are advised to contact us before ordering a sample so that we can assist with this process.

TAXATION RESPONSIBILITY

Contributors/creators hold full responsibility and accountability for any taxes or tax issues associated with the royalties earned and must account for any taxes imposed by governments/governing authorities.

YOUR LIABILITY

Contributors/creators hold full responsibility and accountability for Content and your compliance with our Terms. Contributors/creators agree to indemnify, defend and hold us, our officers, directors, employees, subcontractors, agents and representatives harmless from and against any and all claims, damages, losses, liabilities, costs (including reasonable legal fees) or other expenses of whatever nature that arise directly or indirectly out of or from any of the following associated with you:

Breach of any provision in these Creator Terms
Any and all claims from a third party relating to your Content
Any and all allegations that your Content/materials which have been submitted/transmit to or via our sites or infringe/violate the copyright, trademark, trade secret or other intellectual property rights or other rights of any other third party whatsoever.

The indemnity outlined above will apply without regard to the negligence of any party, which also includes any indemnified person(s) and may not be subject to the termination of your account.

TERMINATION

My Celebration Day reserves the right to suspend or terminate an account at any time, in full or in part and without further notice, for any length of time if we deem the following has occurred:-

Failure to actively participate in our Services for a period of 365 days
Failure to comply with any or all of the provisions of these Terms
Violation of any other applicable regulations, guidelines or laws
Failure to meet our conduct expectations; Your conduct is harmful or detrimental to My Celebration Day, our users, or any third parties.

Creators/contributors reserve the right to close their account and terminate use of our Services at any time by contacting us at info@mycelebrationday.com

In the event of voluntary account closure by a creator/ contributor, we reserve the right to retain data associated with your account in accordance with our privacy notice, and you will retain responsibility for all Content which you made available via our Services and website prior to such termination.
